1. Services Overview
NextBuild provides MVP development services, including product planning, frontend development, backend development, and post-launch support. The services provided are outlined in the project agreement or proposal.
2. Payment Terms
- Project Fees: Fees for services will be outlined in the proposal or contract and agreed upon before the start of any work.
- Payment Schedule: Payments will be made based on the schedule defined in the project agreement. Typically, a portion of the payment is required upfront, and the remaining amount is due upon delivery or completion of key milestones.
- Late Payments: Any late payments will incur a late fee, as outlined in the payment agreement.
- Additional Costs: Any additional features or services requested beyond the original agreement will be charged separately and subject to approval.
3. Project Timelines
NextBuild commits to delivering MVPs within 4 weeks, provided the client meets all feedback and review deadlines. Delays on the client’s side may result in extended timelines, which will be communicated promptly.
4. Client Responsibilities
The client is responsible for:
- Providing timely feedback and approvals during the course of the project.
- Providing necessary content, such as branding materials, images, text, and other assets needed for the project.
- Ensuring that all third-party integrations (such as APIs or external services) comply with legal and regulatory requirements.
5. Revisions and Changes
- Scope of Revisions: Minor revisions are included as part of the development process. Major changes or additional feature requests outside of the agreed-upon scope will incur additional charges and may impact the project timeline.
- Change Requests: All change requests must be made in writing and agreed upon by both parties before they are implemented.
6. Intellectual Property
- Ownership of Deliverables: Upon full payment, the client will own the final MVP code and deliverables. NextBuild retains the right to showcase non-confidential aspects of the project in its portfolio.
- Third-Party Materials: Any third-party software, libraries, or tools used in the development of the MVP will be subject to the licensing terms of the respective providers.
7. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the course of the project. This includes, but is not limited to, trade secrets, business information, or technical data.
8. Post-Launch Support
After the MVP launch, NextBuild offers post-launch support as outlined in the agreement. This includes fixing bugs and implementing feature requests based on the ongoing development package or service plan chosen by the client.
9. Limitations of Liability
NextBuild is not liable for:
- Loss of revenue, profits, or data due to delays, errors, or interruptions in the services provided.
- Third-party software failures or issues beyond NextBuild’s control.
- Any indirect or consequential damages arising from the use of the MVP or services provided.
10. Termination
In the event of termination:
- The client will be billed for services rendered up to the date of termination.
- All work completed to that point will be delivered to the client, provided all outstanding payments have been made.
11. Amendments
NextBuild reserves the right to amend these terms at any time. Clients will be notified of any changes to the terms, which will take effect immediately upon posting to the website or being communicated in writing.
